NIGERIA — The National Industrial Court has handed down a judgement in a lawsuit filed by the Federal Government against the Academic Staff Union of Universities (ASUU) over their demand for salaries while on strike. The court held that it is legal for the government to withhold salaries of striking workers under the no work no pay rule.

Delivering the judgement, the President of the Court, Justice Benedict Kanyip, stated that the Federal Government is within its legal rights to enforce the no work no pay rule as a form of punishment against workers on strike. However, the court also ruled that the imposition of the Integrated Payroll and Personnel Information System (IPPIS) on ASUU members is a violation of university autonomy as the Union has the right to determine how their salaries should be paid.

The court's decision came after ASUU had demanded payment of their salaries for the period of February 14 to October 7, 2022, when the strike was called off. Despite the union's argument that the withholding of their salaries was a violation of their rights, the court upheld the no work no pay rule enforced by the Federal Government.

This judgement is expected to have far-reaching implications for future industrial action by workers in Nigeria, especially in public institutions. It is also expected to embolden the government to take a tougher stance against any form of industrial action.

ASUU has expressed disappointment with the court's decision and plans to appeal the ruling, arguing that it is an attempt to undermine their fight for better working conditions and welfare for academic staff in Nigeria's universities.
